Please read this Legal Notice carefully because it governs your use of wcontent.net and affects your rights and liabilities under the law.
By accessing and using wcontent.net you are agreeing to the terms and conditions contained in this Legal Notice and the Privacy Policy. If you do not agree do not use wcontent.net.
In these terms of business 'we' or 'our' refer to wcontent.net ('the Company').
Your relationship is solely with the Company, and the Company has sole legal liability for the work done for you and for any act or omission in the course of that work. No officer, consultant or employee of the Company will have any personal legal liability for that work whether in contract, tort, negligence or any other cause of action. In particular, the fact that an individual officer, consultant or employee signs in his or her own name any letter or other document in the course of carrying out that work does not mean he or she is assuming any personal legal liability for that letter or document.
We will agree with you at the outset the scope of the work. We are not responsible for matters that are outside the scope of the work agreed. All prices are as quoted on the wcontent.net website. The Company will not be liable for any delays caused during the design process. You must pay to us, on demand, all reasonable costs, charges or losses sustained or incurred by us (including, without limitation, any direct, indirect or consequential losses, loss of profit and loss of reputation, loss or damage to property and those arising from injury to or death of any person and loss of opportunity to deploy resources elsewhere) arising directly or indirectly from any of the following acts or omissions by you: fraud, negligence, failure to perform or delay in the performance of any of your obligations.
Work will commence following full payment and order details either through the website or by email.
All the rights of the design and texts that we created for specific client belong to the client for which it was designed. We do not hold any rights to the design created for a client.
We do not file a trademark application with respect to designs created for its client. The client is free to register as a trademark the design created for it by us.
In the event that payment for any project, text or design is not made in accordance with our payment policies, then all of client's rights in and to the design created for it, including any trademark property, will immediately revert back to us.
We warrant that our designs and texts are our creation and are not copied from or inspired by existing designs or texts but does not warrant that a design or text the same as or similar to that designed by it, but of which it was not aware at the time of its creation, does not exist.
If for some coincidental reason our design or text looks identical to another party's design or texts, we will provide a free redraw session.
We both agree not to issue any publicity material or information to the media about our relationship and the work we are doing without the other's consent, save where the information is already in the public domain.
We routinely use email to communicate, and whilst we have normal levels of security in place, you accept the risk that email communications may not be secure.
We deliver all our final work via e-mail on the date specified in your package.
We keep all files for a maximum of one year. If we do not receive feedback or file requests within that time the project is seen as complete. Full payment is required after that time if you wish to continue any design package.
You may ask us to stop work on your project at any time. If so, please confirm that in writing. We may choose to stop acting for you, but only if we have good reason to do so (for example, if you continually do not give us clear and constructive feedback, or do not make a payment when due). If we stop working for you we are still entitled to be paid for what we have done, and may keep your work until we have been paid.
